The non-applicant/respondent No.1 tendered the reply across the bar, which is taken on record. 2.

Heard.

There is delay of 69 days caused in filing the second appeal. The contention is that the applicant No.1 is old aged lady and is not keeping well. Whereas, the applicant No.2 is a medical representative, who travels constantly across Maharashtra, due to which the appeal could not be filed within the limitation period.

The application is objected by the non-applicants on the ground that the sufficient cause has not been properly explained.

Considering the medical certificate of the applicant No.1 and the fact that the applicant No.2 is a medical representative coupled with the fact that no malafide for delay has been brought on record by the non-applicants,

916 CAS-473-2025 therefore, the delay caused in filing the appeal is hereby condoned subject to payment of costs of Rs.2,000/- to be paid to the Secretary, High Court Legal Services Sub-Committee, Nagpur.
