D. Gawande, Advocate for the petitioner CORAM : ANIL L. PANSARE J.
DATED : 03-03-2025 Heard.
2.
The challenge is to order dated 8-1-2025 passed by the Industrial Court, Amravati below Exhibit U-54 in Complaint (ULP) No. 85/2023.
3.
By the civil application, the petitioner - employee intended to add grievance committee members as party respondents on the count that his transfer was allegedly made on the recommendation of the grievance committee in its enquiry report submitted to the respondent - zilla parishad. The Industrial Court rejected the application on the count that the presence of the committee members is neither necessary nor proper to adjudicate the issue involved, which relates to petitioner's transfer vide order dated 19-7-2023 which admittedly has been made by the respondent. 5.
In context with above, a query was made whether the enquiry report of the grievance committee is challenged, the petitioner's counsel answered in the negative. Thus, the subject matter of challenge is the transfer order issued by the respondent. That being so, the Industrial Court was right in rejecting request made by the petitioner to add the members of the grievance committee whose report is not even challenged
2 wp 1161.2025.odt before the Industrial Court. There is, thus, no merit in the petition. The petition is dismissed in limini. 6.
Nonetheless, if required, the Industrial Court may, if found necessary in future, add all those, who are party necessary to the proceedings.
7.
Writ petition is disposed of in above terms with no order as to costs.
