Heard Shri A.K. Madane, learned Advocate for the applicant and Shri S.B. Bissa, learned A.P.P. for the nonapplicant. The applicant is arrested on 16th of June, 2015 in crime registered against him and two other person for the offences punishable under Sections 392, 397 read with Section 34 of the Indian Penal Code, Sections 3 and 4 of the Indian Arms Act and Section 135 of the Maharashtra Police Act. The prosecution alleges that the three accused (including the applicant) have snatched bag of the informant containing about Rs.10,000/- and his walkie-talkie and ran away.

The application is opposed on the ground that the applicant is involved in similar crime on earlier two occasions. Considering the nature of accusations, the fact that the charge-sheet is filed and the non-applicant has not been able

ba.100.16 2/2 to show that custody of the applicant is required for further investigation, in my view, the applicant is entitled to be released on bail.

Hence, the following order :

i.

The applicant having been arrested in Crime No.186/2015 registered by the non-applicant, he be released on bail on furnishing P.R. Bond in the sum of Rs.10,000/- (Rupees Ten Thousand Only) with one solvent surety in the like amount.

ii. The applicant shall regularly attend the trial unless granted exemption by the trial Court.

iii. The application is allowed in the above terms. JUDGE *sdw
