The application seeks bail for the offences punishable under sections 394, 395 r/w sec. 34 of the Indian Penal Code, in Crime No.783/21. The earlier application for bail (BA) No.276/22, came to be rejected by order dated 12-04-2022. The only change, according to the applicant, is the framing of the charge on 14-12-22. The programme for the trial is already fixed and already started but did not work out, due to non production of some of the accused who are lodged in jail. I do not consider this to be a change in circumstance to enlarge the applicant on bail. Hence, the application is rejected.

It is necessary to clarify, that since the delay in trial is being occasioned due to non production of some of the accused, it would be permissible for the learned Sessions Court to ensure their appearance through Video conferencing
