DATE : 1.3.2016 Heard Shri P.V. Thakre, advocate for the applicant and Shri N.B. Jawade, A.P.P. for the non-applicant. The applicant is seeking pre-arrest bail apprehending arrest in Crime No.3/2016 registered against him for the offence punishable under Section 409 and 420 of the Indian Penal Code.

The accusations against the applicant are that he has misappropriated the amount of Rs.31,232/- which he had received from the recurring deposit account holders and had not deposited the amount. The learned A.P.P. has pointed that Crime No.17/2015 is registered against the applicant for similar offence.

2 aba94.16 The learned advocate for the applicant has submitted that the applicant has deposited the amount.

Considering the facts on the record and the nature of allegations, in my view, the applicant is entitled for pre-arrest bail.

In the event of arrest of applicant in Crime No.3/2016 registered by the non-applicant, the applicant be released on bail on furnishing P.R. bond in the sum of Rs.10,000/- (Rs. Ten Thousand Only). The application is allowed accordingly. JUDGE Tambaskar.
