After this matter was argued for sometime Shri Naidu, learned counsel for the petitioner based on instructions from the petitioner seeks leave to withdraw this petition with liberty to file an appropriate complaint before the concerned Magistrate. He states that such complaint will be filed within two weeks from today and requests that some order is to be issued for expeditious disposal of such complaint.

According to us, in the facts of the present case, such a request is quite reasonable. Accordingly, if such complaint is filed then, the concerned Court to dispose of the same as expeditiously as possible and preferably within three months from the date of its institution. 3.

We make it clear that we have not examined the rival contentions on merits. At the same time, we also make

34 crwp184.21.odt it clear that the concerned Court, will have to examine it in accord with law and on its own merits without being influenced by opinion of the investigating authority that this is only a civil matter. All contents from all parties in this regard are therefore left expressly open.
