The applicant is apprehending arrest in Crime 502/2020 registered with Police Station Kapilnagar, Nagpur for offences punishable under Sections 307, 323, 506 read with Section 34 of the Indian Penal Code.

While the report, which is lodged by the brother of the injured alleges that the applicant used fist blows to assault the injured, the learned APP Mr. Pathan fairly points out that according to the injured the applicant was only present on the scene of the occurrence and that the injured has not attributed any direct role to the applicant in the assault.

The interim protection granted vide order dated 26.02.2021 is made absolute with the only modification that till the charge-sheet is filed, the applicant shall attend the

The application is disposed of.
