Shri Thakare, the learned Additional Government Pleader appearing on behalf of the respondent nos.1 & 2, states that during the pendency of the writ petition, the process initiated in pursuance of the tender notice was cancelled and the State Government has decided to get the work executed through the Maharashtra Jeevan Pradhikaran.

Shri Kalwaghe, the learned counsel for the petitioners, states that in view of the subsequent development, a fresh cause of action would arise and the petitioners would take appropriate steps for challenging the subsequent action, if need be.

In view of the statements recorded hereinabove, we dispose of the writ petition with no order as to costs. JUDGE JUDGE APTE
