CORAM : SMT. VASANTI A NAIK AND MRS. SWAPNA JOSHI, JJ.

DATED : MARCH 19, 2018.

Heard.

By this criminal writ petition, the petitioner challenges the order of the D.I.G. Prisons, Nagpur dated 4.12.2017 rejecting the application of the petitioner for grant of furlough leave.

It appears that when the petitioner was released on furlough leave in the year 2013, he returned to the prison 1370 days after the due date. Immediately after he returned to the prison, the petitioner had applied for furlough leave. The petitioner must mend his ways. It would not be proper to release the petitioner on furlough leave within a short time, as he was absconding for nearly four years. The petitioner shall wait and improve his conduct to seek his release on furlough leave.

In the circumstances of the case, we dismiss the criminal writ petition with no order as to costs. JUDGE JUDGE Gulande
