DATE : 10/02/2023 The applicant is facing accusation in C.R.No.36/2023, which is invoked offences punishable under Sections 363, 385, 387 and 448 of the Indian Penal Code, 1860.

Since all the offences would result into punishment which may extent to seven years, it is imperative for the Investigating Officer to issue notice under Section 41-A of Cr.P.C. in terms of the latest authoritative pronouncement of the Hon'
ble Supreme Court in the case of Satyendra Kumar Antil vs. CBI (2022) 10 SCC 51.

Upon issuance of notice the applicant shall report to the Investigating Officer within a period of KOLHE
2 / 2 16-ABA 98.2023 three days of its receipt and render his co-operation in the investigation.
In case the Investigating Officer arrived at a conclusion that the custodial interrogation of the applicant is necessary. He shall specifically record his reasons to that effect.
Failure on the part of the applicant to report to the Investigating Officer, would confer the liberty upon the Investigating Officer to effect his arrest.
