In the Contempt Petition, the contempt is alleged against the judgment and order passed by this Court dated 08.11.2019. However, it is pointed out that this matter went upto the Hon'ble Supreme Court and after the decision of the Hon'ble Supreme Court, the matter was remanded back to learned Central Government Industrial Tribunal, Nagpur. In the said proceedings, the matter has been compromised between the parties. The respondent has placed on record the pursis dated 14.10.2025 and specifically stated in paragraph No.7 and 8 of the pursis as under:

"7.

That a joint compromise memo was submitted before the Hon'ble CGIT by Petitioner and the Respondent No.1 on 25.03.2025. The Hon'ble

CGIT taking note of the settlement arrived at between the parties disposed the matter vide order dated 25.03.2025 as follows:

"The reference is answered in favour of the workmen in terms of the settlement mentioned in the memo of compromise. The memo of settlement dated 25.03.2025 is made part of the award".

The present Respondent as per the said settlement arrived at paid an amount of Rs 5,00,000/- (Five lakhs only) to the Petitioner herein on 25.03.2025 as full and final settlement of all the disputes between the parties as recorded in the joint compromise memo dated 25.03.2025.

The award of Hon'ble CGIT dated 25.03.2025 is Annexed as Annexure B.

That as per the Terms and conditions of the Joint Compromise Memo dated 25.03.2025 filed before the Hon'ble CGIT and which is part of the award of Hon'ble CGIT dated 25.03.2025, the Petitioner in this Contempt Petition has agreed to withdraw this pending Contempt Petition No. 76 of 2020."

Since the matter has been compromised between the parties, the petitioner has remained no grievance in the matter and the fact that the order has been modify by the Hon'ble Supreme Court, I am of the opinion that the present Contempt Petition is purged and same is required to be dropped against the present respondent. Hence, the Contempt Petition stands disposed of.

CIVIL APPLICATION (CAN) NO.116/2025 1.

In view of the compromise between the parties and amount which was already deposited before this Court, the permission is sought by the respondent No.2 to withdraw the balance amount of Rs.18,89,590/- along with interest accrued thereon from the Registry of this Court. 2.

Learned Counsel appearing for the petitioner has no objection for withdrawal of the amount, in view of the fact that the matter has been already compromised between the parties.

The application is allowed as prayed for.
