The claimant seeks permission to withdraw the amount of compensation deposited by the appellant. The reference Court has enhanced the compensation for the land from Rs.61,757/- per hectare to Rs.1,50,000/- per hectare. Similarly, for the orange trees, the rate of Rs.3500/- per tree has been granted.

Considering the nature of evidence on record, the claimant is permitted to withdraw a sum of Rs.15,00,000/- on filing an undertaking that in case the appeal is allowed, the said amount shall be repaid with interest at such rate the Court may direct. The remaining amount is permitted to be withdrawn on furnishing solvent/surety/security to the satisfaction of the Registrar (Judicial).

Civil application is allowed and disposed of. JUDGE /MULEY/
