IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

NAGPUR BENCH, AT NAGPUR.

Writ Petition No. 2256 of 2025 [Smita w/o Suresh Kamdi ..vs.. Y. Mandpe, Advocate for the petitioner CORAM : ANIL L. PANSARE J.

DATED : 24-04-2025 Heard.

2.

The petitioner and respondent are wife and husband. Learned counsel for the petitioner submits that the respondent has filed proceedings under Hindu Marriage Act against the petitioner seeking divorce. The respondent moved application seeking injunction restraining petitioner to stay away from the respondent and not to visit his workplace. 3.

The Family Court vide order dated 1-2-2020 granted interim relief which has been confirmed vide impugned order dated 9-9-2021.

4.

The Family Court found substance in the apprehension put forth by the respondent that petitioner is, for no valid reason, visiting workplace of the respondent. It appears that the criminal proceedings were also initiated and the relations between the parties are strained. Accordingly, the Family Court has confirmed the order dated 1-2-2020. 5.

As could be seen, the order dated 1-2-2020 has been confirmed on 9-9-2021. For all these years, the petitioner kept quite. In other words, she accepted the verdict and after four years has suddenly approached this Court. 6.

Considering the fact that the proceedings are still pending before the Family Court and further considering the
