Heard Mr. A. S. Manohar, learned Counsel for the petitioner.

Mr. Manohar, learned Counsel for the petitioner, based on instructions from the petitioner, seeks leave to withdraw this petition with liberty to file a fresh complaint under the Banking Ombudsman Scheme, 2006 by complying with the directions contained in paragraph 3 of the impugned order dated 11.05.2018.

We grant leave to the petitioner to withdraw this petition with liberty as prayed for.

Further, we direct that if such complaint is indeed filed before the ombudsman within a period of 6 weeks from today, then, ombudsman, to consider the same on its own merits and in accord with law without going into the issue of delay or latches. This is because we find that after the impugned order was made on 11.05.2018, this petition was

15.Cri.W.P.No.155.20 instituted in this Court and the same was pending. Besides, we note that pursuing such matter was rendered difficult on account of the pandemic situation.

This petition is disposed of with liberty as aforesaid. There should be no order for costs. 6.
