APRIL 27, 2018 Heard Shri Patil learned counsel for the applicant and Ms. Kalia, learned APP for the State. Perused the reply of the prosecution and the case diary. Only allegation made against this applicant is that being a Gram Sevak, this applicant rendered some assistance to the main accused, who was working as a Branch Post Master, who opened fake accounts in furtherance of his fraudulent activity of misappropriating government funds. However, there is no material available on record indicating something which has been done by this applicant as a part of the alleged assistance given by him to the main accused.
The main accused, it is submitted by learned counsel for the applicant, has admitted his guilt and he has also deposited the entire amount alleged to be misappropriated by him which comes to approximately
ABA89.18 Rs.1,83,460/-.
It is also an admitted fact that this applicant since initial stage of investigation has co-operated with the Investigating Officer as he had attended police station on being summoned and his statement was also recorded. In view of above, I am inclined to allow this application and it is allowed accordingly. Ad-interim anticipatory bail granted by this Court on 13.02.2018 is hereby confirmed on the same conditions with clarification that the applicant need not attend the police station except when he is called upon to do so by the Investigating Officer.
The application stands disposed of.
