DATE : 07/02/2023 The order passed by the Collector dated 09/03/2020 under the Maharashtra Minor Mineral Extraction (Development and Regulation) Rules, 2013 is under challenge in this petition.

Since the Court is not inclined to entertain the writ petition as alternate remedy by way of an appeal is provided, on instructions learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to file an appeal by keeping all the points raised in the writ petition including the point that the Collector has not passed the order as per the directions issued by this Court while remanding the matter to the Collector.

The petitioner is permitted to withdraw the present writ petition with liberty as prayed for. 4.

As regards the delay, the Commissioner shall consider the time spent in pursuing the present writ petition.

The Commissioner is requested to decide the appeal within six months from the date of filing of the appeal.
