This is an application for modification of order dated 10/01/2024. It is submitted that as per the order dated 10/01/2024, the Public Works Department has deposited a Demand Draft of Rs.2,81,01,298/-(Two Crore Eighty One Lakh One Thousand Two Hundred and Ninety Eight Only), dated 23/02/2024, with the Registrar High Court.

It is submitted that there are more than 200 claimants and if the Demand Draft is encashed by the Registry of this Court, it would be a difficult task to pay the amount to claimants who are in large number. It is therefore suggested that the department shall pay the amount directly to the claimants.

In the circumstances, considering the fact that there are more than 200 claimants, we are of the opinion that the mode as suggested by the petitioner, would be appropriate mode to disburse the amount in favour of all the claimants.

Accordingly, we direct the Registrar to return back the Demand Draft to the Deputy Executive Engineer, Public Works Department, Pandharkawada and we further direct the respondents to disburse the amount in the account of respective petitioners on furnishing account details by petitioners, within a period of three months. So far as, amount towards statutory interest is concerned, it shall be deposited as per provisions of law, within a period of two months thereafter.

Accordingly, paragraph No. 3 of the order dated 10/01/2024 is modified and the same shall be re uploaded.

The application is disposed of.
