Rule. Rule made returnable forthwith and heard the learned counsel for the parties.

The petitioner seeks issuance of Validity Certificate of belonging to 'Thakur' Scheduled Tribe. It is her case that her father has been issued a Validity Certificate in view of the Judgment of this Court in Writ Petition No.1496/2017 (Vinayak s/o Babaro Wankhade vs. The Scheduled Tribe Caste Certificate Scrutiny Committee, Amravati and anr.) decided on 28/02/2019. Since the claim is pending with the respondent No.2, the petitioner has approached this Court.

Learned Assistant Government Pleader on instructions submits that the petitioner can be directed to appear before the Scrutiny Committee along with all original documents. On verification of the same, necessary decision would be taken by the Scrutiny Committee.

Accordingly, the following order is passed :
(a) The petitioner shall appear before the Scrutiny Committee on 14/06/2023 along with all original documents as well as Validity

(b) The Scrutiny Committee shall consider the aforesaid documents and if there is no legal impediment, it shall take into consideration the decision of this Court in Apporva d/o Vinay Nichale vs. Divisional Caste Certificate Scrutiny Committee-I and ors. 2010 (6) Mh.L.J. 401 and issue Validity Certificate to the petitioner. The necessary exercise be completed within a period of six weeks from 14/06/2023.
