Advocate Vaishnav is praying for recalling the order dated 14.1.2016 dismissing W.P.No. 3693/2015 in default. Application is within time. Learned AGP is seeking time to verify the record. However, as we do not see any malafide, application is allowed. Writ Petition No.3693/15 is restored to file. M.C.A. is allowed and disposed of. W.P. No.3693/2015 Heard respective counsel for the parties.

This court has issued notice in this petition on 3/7/2015. Effort of petitioner is to challenge G.R. dated 20.6.2014. Petitioner relies upon a communication dated 29/9/2014 to show

mca231-16 cause of action. However, on the basis of oral arguments we are not in position to accept and appreciate the same.

In this situation, as notice was already issued, we grant petitioner leave to make appropriate representation pointing out his grievance against said G.R. to respondents. If the G.R. is used against the petitioner, petitioner can also state the same in the representation.

If such a representation is made to the respondents within four weeks from today, the respondents shall attempt to look into it within next four months.

Keeping all rival contentions open, we dispose of petition. No costs.
