DATE : February 22, 2018 The applicant who was enlarged on bail by order dated 14/11/2017 has moved this application seeking relaxation of the condition by which he was prevented from entering the jurisdiction of Katol Police Station till the completion of the trial.
In the application it is stated that the applicant is presently residing at Wadi and for conducting agricultural operations he be permitted to visit his village from 8 am to 8 pm.
Reply has been filed on behalf of the non-applicant State opposing the application. It is stated that the house of the applicant and that of the deceased are adjoining each other. It is further stated that about eleven persons which include prominent villagers vide application dated 19/02/2018 have
13-APPP-215-18 2/2 opposed the entry of the applicant in the village. Considering the fact that the applicant is a neighbour of the deceased the aforesaid condition of not entering the concerned village was imposed. In the light of statements made by various villagers and considering the vicinity of the house of the applicant with that of the deceased, I am not inclined to modify the aforesaid condition. However, the proceedings in the criminal trial are expedited. Criminal Application is disposed of.
