Prayer of the Petitioner is to direct the Governor of Maharashtra to decide the pending appeal.

For issuance of such direction in the nature of writ of mandamus, first it has to be demonstrated that there is a failure of public duty. Even assuming such a writ of mandamus can be issued,

Order 2303wp1593-22 considering the duties of the office of the Governor, we do not consider the period from which the appeal is pending, as a gross failure so as to warrant any issue of writ of mandamus. However, we observe that the office of the Governor will no doubt decide the appeal as expeditiously as possible.
