The challenge is to the order dated 24.12.2018 passed by the respondent - Committee wherein not only the claim of the petitioner of belonging to Rajput Bhamta (V.J.) category for issuance of the validity is rejected but also the Committee forfeited the validity certificate of the father of the petitioner.

It could be inferred from the record that the father of the petitioner was never put to notice before the forfeiture of the validity certificate. Prity

Apart from above, it was for the Committee to trace the papers in relation to the validity certificate of the father before recording any findings. The order of the Committee lacks the aforesaid consideration, it not only suffers from nonapplication of mind but there is also absence of requisite reasons for rejection of the claim, and therefore, the same is set aside.

As such, the impugned order dated 24.12.2018 passed by the Committee is hereby quashed and set aside. It is further clarified that even the decision of the Committee of forfeiting the validity certificate of the father of the petitioner is also illegal and same is also set aside.

The petition stands allowed in the above terms.
