Shri A.B. Patil, learned Advocate for the respondent submits that the petitioner is liable to pay exemplary costs for the abuse of process of law. Considering the facts of the case, the petitioner shall pay costs of Rs.5,000/- to the respondent. The amount of costs shall be paid and receipt shall be produced on the record of the trial Court within one month.

The petition is dismissed as withdrawn.
