Heard Shri R.K.Tiwari, advocate for the applicant and Shri T.A. Mirza, A.P.P. for the non-applicant. The learned advocate for the applicant has submitted that the applicants have deposited Rs.50,000/- each as per the order passed by this Court on 10th February, 2016. The applicants are apprehending arrest in crime registered against them along with their son Sunil on the accusation that the complainant has paid Rs.14 Lakhs to Sunil on the false assurance given by Sunil that he will enable the complainant to get a job. The allegations against the applicants are that the complainant had paid Rs.50,000/- to each of the applicant in cash.

2 aba68.16 Considering the age of the applicants and their social status and the fact that they had not been involved in any crime earlier and looking to the nature of the allegations against them, in my view, the applicants are entitled for prearrest bail. The ad-interim order passed by this Court on 10th February, 2016 is confirmed. It is directed that in the event of arrest in relation to Crime No. 200 of 2015, registered by the non-applicant, the applicants shall be released on bail on furnishing P.R. Bond in the sum of Rs.Ten Thousand each and one solvent surety each in the like amount. The disbursement of the amount of Rs. One Lakh, deposited by the applicants shall be as per the order that may be passed by the trial Court.
