The applicant is apprehending arrest in Crime 8/2020 registered with the Lonar Police Station for offence punishable under Section 406 read with 34 of the Indian Penal Code.
2] The submission is that the applicant, who is the owner of Jayashree Gajanan Roadlines merely acted as a facilitator or a middleman to transport the goods of the complainant.
3] It is not in dispute that the applicant is neither the owner of the truck which was engaged to transport the goods of the complainant nor was the applicant in a position to exercise supervisory control over the driver Satish. 4] It appears that the driver Satish, who is
aba101.20.O.odt absconding, fled with the truck and the goods. 5] At this stage, there is no material on record to connect the applicant with the alleged crime. The affidavit of the State is that the applicant was in contact with the driver of the vehicle till 09.12.2019. This is not disputed by the applicant. According to the applicant, thereafter the driver switched off the mobile.
6] The interim order dated 18.02.2020 is made absolute with the modification that the applicant shall attend Police Station Lonar as and when directed by the Investigating Officer.
