Perused the record of the matter as well as the reply on behalf of non-applicant No.1. In the reply, it is specifically stated that the investigation is already completed in the matter and charge-sheet was filed on 14.07.2020. After that, when this matter was listed on 10.12.2020, this fact was not brought to the notice of this Court. Hence, this Court issued notices and by interim order stated that though investigation may go on, the investigating officer shall not file charge-sheet. 2.

Since 2020, till today, this fact was not brought to the notice of this Court by the applicant. The said fact came to the notice only after the reply filed by the non-applicant. 3.

In the circumstances, the applicant is permitted to withdraw the present application with a liberty to file afresh if so advice to challenge the charge-sheet or to adopt other

All the issues are kept open.

The application stands disposed of.
