Heard Shri Apurva De, learned Counsel for the petitioners, Shri S.B. Bissa, learned A.G.P. for respondent no.1 and Shri P.A. Markandeywar, learned Counsel for respondent no.2.

One of the contention of Shri De, learned counsel for petitioners is, petitioners have not been given opportunity of hearing before canceling the approval. This fact is not in dispute.

Petitioner no.1 is due for superannuation on 31.07.2016, which happens to be Sunday.

In this situation, we set aside the

impugned order dated 05.02.2015. Parties are directed to appear before respondent no.1 on 25.07.2016 at 10.30 a.m.

Respondent no.2 states that on that day she shall make records of Education Society available for perusal of respondent no.1.

Secretary of the said Education Society shall also remain present on 25.07.2016 with necessary records.

Respondent no.1 shall attempt to take fresh decision at the earliest and in any case before superannuation of petitioner no.1.

With these directions, we dispose of the Writ Petition. No costs.

Copy of this order be furnished to learned counsel for the parties to act upon.
