In this Letters Patent Appeal the order passed by the learned Single Judge dated 05.01.2009 is under challenge. By that order the writ petition was dismissed and the resolution dated 29.09.2005 passed by the Regional Transport Authority imposing restrictions on the plying routes of six seater autorickshaws was upheld. It is seen that on the recommendations made by the Study Group the Regional Transport Authority passed its resolution and accepted said recommendations on 29.09.2005. The resolution was to operate for a period of five years from that date. With the passage of time and in view of the further fact that during the pendency of the writ petition as well as the letters patent appeal, there was no interim order operating, the challenge as made has been rendered infructuous.
By keeping all the points raised open, the Letters Patent Appeal is disposed of as having been rendered infructuous. The parties shall bear their own costs.
