Purpose of filing petition will be served if the Trial Court is directed to consider the request of the petitioner - Judgment Debtor to first decide the application filed by the petitioner for setting aside the ex parte judgment in Special Civil Suit No.10/2017 and after deciding such application, to proceed with the execution proceedings. 3.

The petitioner shall make such a request before the Trial Court who shall consider the same, in accordance with law. 4.

In any case, if the application for setting aside ex parte judgment and decree is filed, it will be appropriate for the Trial Court to decide the same first and, thereafter, to proceed with the execution proceedings.

The writ petition is disposed of with the above observations. No order as to costs.
