It is not in dispute that the application for discharge made by the applicant before the trial Judge was second in point of time though on a ground, which was not taken in the first application for discharge. In my opinion, in order to avoid procrastination of trial the accused cannot be allowed to go on filing discharge applications by pressing into service the grounds one after other. The trial is pending since the year 2006 and, therefore, I think, following order would subserve the interest of justice.

ORDER

(i) Criminal Revision No.24/2015 is disposed of.

(ii) Order dated 16.02.2015 passed by Special Judge, Akola in Special Case No.57/2006 is confirmed. The trial Judge is directed to expedite the trial and complete the same within six months. All the points raised are kept open.
