The learned counsel for the respondents raise a preliminary objection to the tenability of the writ petition on the ground that the petitioner has an alternate efficacious remedy of filing an appeal before the Regional Deputy Commissioner, Social Welfare Department. The learned counsel for the respondents have relied on the judgment of the Hon'ble Supreme Court reported in (2006) 9 SCC 782 (Dagdu Versus President, Anandrao Naik Shikshan Prasarak Mandal & Others), in this regard.
By upholding the preliminary objection raised on behalf of the respondents, we dispose of the writ petition with no order as to costs.
