DATE : 27.07.2022 Mr. Kukday, learned counsel for petitioners, on instructions seeks leave to withdraw the present petition as the question, whether respondent no.6 is President or the petitioner nos.1 and 2 are the President and Secretary of Savitribai Fule Mahila Bachat Gat, Aamdari, is a disputed question between them.

The impugned orders, grant the license of the fair price shop to Savitribai Fule Mahila Bachat Gat, Aamdari, though on the basis of the proceedings initiated by respondent no.6. It is therefore apparent that the license to run the fair price shop is not granted to respondent no.6 in person but to the Savitribai Fule Mahila Bachat Gat, Aamdari. 3.

That being the position, in case, in an appropriate proceedings if the petitioners are able to establish that respondent no.6 has been removed from the post of President

(2) wp2166.21 of Savitribai Fule Mahila Bachat Gat, Aamdari and also establish that they are legally elected President and Secretary, it would be axiomatic that the petitioners would be entitled as President and Secretary to run the fair price shop. 4.

The petition is accordingly dismissed as withdrawn.
