The applicant is arrested on 11-06-2015 in crime registered against him and another for offences punishable under Sections 302 and 201 read with Section 34 of the Indian Penal Code.

The applicant is arrested on the basis of circumstantial evidence. According to the non-applicant, there is discovery of blood stained clothes of the applicant. The further objection for granting bail is that the witnesses are residents of same locality. 4.
The charge-sheet is filed on 21-08-2015. The non-applicant has not been able to show that custody of the applicant is required for further investigation. Considering the facts on record, in my view, the applicant is entitled to be released on bail, however, on
2 ba108.16 certain conditions.

Hence, the following order :
i) The applicant having been arrested in Crime No. 215/2015 registered by the non-applicant, the applicant be released on bail, on furnishing P.R. Bond for Rs.20,000/- and two solvent sureties in the like amount.
ii) The learned Advocate for the applicant, on instructions, states that the applicant will be staying at Akola. The applicant shall supply the address and phone number of the applicant as well as the person with whom the applicant would be staying to the Investigating Officer before he is released on bail.
iii) The applicant shall not enter Amravati City except for attending the sessions trial.
iv) The applicant shall regularly attend the sessions trial unless granted exemption by the Sessions Court.
