Shri S.M. Bahirwar, learned counsel for the petitioner fairly states that as the petitioner has denied status of the respondent as wife, the present criminal writ petition has been filed for quashing of proceedings filed before the trial Court under the Protection of Woman from Domestic Violence Act, 2005 (hereinafter referred to as D.V. Act).

The order impugned is one dated 11.01.2017 by which the respondent sought relief of interim maintenance under Section 23 of the D.V. Act. That application has been allowed.

The proceedings are, therefore, pending before the said Court. The provisions of Protection of Women from Domestic Violence Act, 2005, allow the petitioner other remedies against the impugned order.

Hence, with liberty to the petitioner to exhaust those remedies and keeping all contentions open, we dispose of the present petition. No costs.
