The learned Counsel appearing for the non-applicant/husband/original complainant would submit that the criminal dispute has been settled before the Family Court in which the parties have agreed to withdraw all pending proceedings, including the existing criminal application. In support of said contention, he has produced certified copy of the decree of divorce obtained by mutual consent in Family Court dated Rgd.

Order 2607apl195.20 27.01.2021. He has also produced copy of an application filed in the Family Court whereby the parties have agreed to withdraw all pending proceedings including Criminal M.A.

No.2286/2017 and present Criminal Application. 3.

This application raises challenge to the order of issuance of process against applicants in Criminal M.A.No.2286/2017.

As per the agreement, the said complaint was agreed to be withdrawn by the non-applicant. The learned counsel appearing for the non-applicant would submit that in view of the settlement, the nonapplicant undertakes to withdraw the said private complaint filed against applicants.

In view of that nothing survives, however, as applicants are absent and not coming forward to make submissions, in the circumstances, Criminal Application is disposed of for want of prosecution.
