Heard learned counsel for rival parties. Perused the Injury Report/Certificate of the victim.

The offence registered against Applicant is under Section 307 of Indian Penal Code. The Applicant is in jail since 16th May, 2014. Admittedly, the offence under Section 324 is converted into Section 307 of Indian Penal Code looking to the nature of injury seen from the Injury Certificate.

Learned APP points out that the applicant is a habitual criminal and has shown the crime chart. The Crime Chart dates back to the year 2000-01 and there are as many as fourteen cases against the applicant, out of which cases numbering nine are in relation to assault.

In that view of the matter, the following order is passed:-

O R D E R

[a] Criminal Application No. 126 of 2015 is allowed.

[b] Applicant be released on bail upon furnishing a Personal Bond in a sum of Rs.

10,000/- [rupees ten thousand only] with one surety in the like amount.

[c] The applicant shall not enter Amravati city.

As per consent of the applicant, he shall stay in Akola.

[d] Applicant shall report to Akola City Police Station, Akola on last Sunday of every month between 11.00 a.m., and 4.00 p.m., [e] Akola City Police Station shall keep surveillance on the applicant till the end of trial.
