The learned Advocate for the applicant submits that after filing of this application under Section 11 of the Arbitration and Conciliation Act, 1996 the non-applicant has appointed an Arbitrator to resolve the dispute between the parties and the applicant is agreeable for arbitration by the learned Arbitrator appointed by the non-applicant.

In view of the above, the cause of action for prosecuting the application does not survive. The application is disposed accordingly. No costs. JUDGE Tambaskar.
