A statement is made by the learned counsel Shri A.B. Mirza that the appellants have surrendered before the 7th District & Sessions Judge, Nagpur. The statement is accepted.

The conviction is for offence punishable under section 307 read with section 34 of the Indian Penal Code and the applicants are sentenced to suffer rigorous imprisonment for three years.

Applicant - 2 is a lady.

Even otherwise, considering the nature of the accusation and the material on record, I am satisfied that a case is made out for suspension of sentence.

The substantive sentence is suspended.

If the applicants are in custody, they shall be released forthwith on furnishing personal bond of Rs. 16,000/- each and thereafter furnishing solvent surety of like amount within two weeks from release.
