DATE : 9.3.2016 Heard Shri S.V. Sirpurkar, advocate for the applicants and Shri S.S. Doifode, A.P.P. for the non-applicant.

The applicants are seeking pre-arrest bail apprehending arrest in crime registered against them for the offence punishable under Section 306 read with Section 34 of the Indian Penal Code. The allegations against the applicants are that deceased Bharti committed suicide because of the constant harassment and ill-treatment meted out to her to compel her to bring share of her maternal property.

The applicant no.1 is husband of deceased Bharti and applicant no.2 is younger brother of applicant no.1. The applicant

2 aba99.16 no.1 and deceased Bharti were staying at Mumbai and applicant no.2 had been residing at Akola. The non-applicant has not been able to show that the custodial interrogation of applicants is necessary. In my view, the interim order granted by this Court on 18th February, 2016 is required to be confirmed.

Hence, the following order:

(i) In the event of arrest of applicants in Crime No.179/2015 registered by the non-applicant, they be released on bail on furnishing P.R. bond in the sum of Rs.25,000/- (Rs. Twenty Five Thousand Only) each and one solvent surety in the like amount for each of the applicant.

(ii) The application is allowed in the above terms. JUDGE Tambaskar.
