The grievance of the petitioner is that though after having been appointed with respondent No.2-Municipal Council through absorption order dated 26/12/2018 and as per seniority and qualification she is entitled for the post of Upper Division Teacher, respondent No.2 has issued an advertisement dated 09/01/2024 for the post of Upper Division Teacher. 3.
Shri C. B. Dharmadhikari, learned counsel for the petitioner submitted that in spite of there being vacancy, respondent No.2 is not extending such benefit to the petitioner though her representation dated 09/11/2023 (Annexure-B page 15 of the writ petition) is pending with respondent No.2. 4.
Since the order proposed to be passed is innocuous, notice on respondent Nos.2 and 3 is dispensed with. Shri S. M. Ukey, learned Additional Government appears for respondent No.1. 5.
The writ petition is disposed of with directions to respondent No.2Chief Executive Officer, Municipal Council, Khapa to decide the representation of the petitioner dated 09/11/2023 after considering the pleadings in the petition and pass appropriate order in any case within a period of eight weeks from production of this order. 6.
