Heard the learned counsel for the parties.

Having regard to the reasons set out in the transfer application, the same is absolute in terms of prayer clause (1), which reads as follows :

"Transfer the H.M.P. No.60/2020 (Annexure-B) which is pending before Civil Judge (Senior Division), Achalpur to the Court of Civil Judge (Senior Division), Akot in the interest of justice."

The learned counsel for the non-applicant submits that the distance between two places is hardly 60 km and therefore, there is no necessity for transfer. According to him, if the distance is only 60 km, then transfer will not prejudice the respondent. 4.

Accordingly, the transfer application is disposed of in the aforesaid terms.
