The applicant is the original appellant no.2 in Criminal Appeal No.35 of 2018, along with two other appellants, he has challenged his conviction recorded by the learned Special Judge under M.P.I.D. Act and Additional Sessions Judge-5, Nagpur in Special Criminal M.P.I.D. Case No.03 of 2001. 2.

The appeal was admitted vide order dated 25.01.2018 and his substantive sentence is suspended till fnal disposal of the appeal.

The applicant seeks permission to go abroad for a period of one month by this application contending that his son stays at UAE (United Arab Emirates) along with his family and the applicant intends to go to meet his son and his family. The

6 Cri.Appeal-35-2018 applicant has averred that he has well established business, movable and immovable properties within the jurisdiction of this Court and he has deep roots in the society.

Taking into consideration the fact that during the trial and after conviction, the applicant was released on bail and he has never misused the facility of bail, since the applicant is a businessman having movable and immovable properties and that the applicant has deep roots in the society, the prayer of the applicant deserves to be allowed.

The application, therefore, is allowed in terms of prayer made therein.

The application is disposed of.

7.

After coming back, the applicant shall inform the Registry of this Court.
