96 OF Upon instructions, learned counsel for the petitioners seeks leave of the Court to withdraw the petition with liberty to approach the concerned Judicial Magistrate for challenging the "C-summary" report pending before him, keeping all the questions open. Leave with liberty as prayed for is granted. The petition is dismissed as withdrawn with aforestated liberty.

CRIMINAL WRIT PETITION NO. 724 OF 2004 Nobody is appearing in this petition since long. On 07.01.2020, this fact has been recorded specifically by

CRIWP724.04+96.06.odt this Court. Since then also there is no improvement. Besides, "C-summary" has also been filed and therefore, the petitioners would have liberty to challenge the same by approaching the concerned Judicial Magistrate, if they desire to do so.

In these circumstances, the petition stands dismissed with liberty as aforestated.
