This is an application for condonation of delay in preferring an appeal challenging judgment and order of conviction. Delay is of 512 days.

Learned counsel Shri D.A.Sonwane was appointed by the High Court Legal Services Sub Committee at Nagpur to file an appeal on behalf of the appellant. Accordingly, he prepared the appeal. However, since the appeal was barred by limitation, he filed an application for condonation. When the application for condonation of delay came up for hearing, it was revealed to him that the appellant has already filed his appeal through his private Advocate Shri Ashwin Wasnik and said Criminal Appeal No.31/2021 is already admitted by this Court (Coram : Z.A.Haq and Amit B.Borkar, JJ.) on 13.1.2021. Also, the paper book is ready. The said appeal is also listed today for perusal of the Court.

In such view of the matter, since nothing survives in the present application for condonation of delay, the said application stands disposed of. Resultantly, Criminal Appeal .....2/-

appa265.22 27 St.No.1583/2022, which is yet to be numbered, also stands disposed of.

Fees payable to learned counsel Shri D.A.Sonwane appointed by the High Court Legal Services Sub Committee at Nagpur to represent the applicant are quantified at Rs.3500/- from the said Committee.
