20th April, 2016 Heard Shri R.S. Kurekar, learned Adv., for the Applicant and Shri A.D. Sonak, learned Addl. Public Prosecutor for the non-applicant.
The applicant is arrested on 17th December, 2015 in the crime registered against four persons [including the applicant] for offences punishable under Sections 341, 307, 294 and 506 read with Section 34 of Indian Penal Code. According to the prosecution, the applicant threatened the complainant and assaulted him by an iron pipe, because of which the complainant suffered injuries on his left leg.
The learned Adv., for the Applicant makes a statement that other three accused have surrendered on 13th April, 2016.
Considering the nature of accusations against the applicant and as the Non-applicant has not been able to show that the custody of the applicant is required for further investigation, in my view, the applicant is entitled to be released on bail. Hence the following order:-
O R D E R
The applicant having been arrested in Crime No. 225/2015 registered by the Nonapplicant, he be released on bail on furnishing Personal Bond for Rs. 10,000-00 [rupees ten thousand only] with one solvent surety in the like amount.
Criminal Application No. 115 of 2016 is allowed in the above terms.
