The offences registered against the applicant are under Sections 65 (a) and 83 of the Maharashtra Prohibition act and Section 188 of the Indian Penal Code. Necessary seizures have been effected and charge-sheet has also been filed. In such circumstances, no fruitful purpose will be served in keeping the applicant behind the bars any more. Hence, I am inclined to allow this application. Application is allowed and it is directed that the applicant be released on bail in Crime No. 28/2017 registered with Police Station, Ballarpur for the offences punishable under Sections 65 (a) and 83 of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Code on his furnishing PR Bond of Rs. 50,000/- together with one solvent surety in the like sum, on the following conditions : (i) Applicant shall attend Police Station, Ballarpur on every Friday and Saturday between 06.00 pm and 07.00 pm during the pendency of trial.
(ii) Applicant shall not indulge in any criminal
2 ba187.17 conduct or commission of similar nature of offences and if any new offence is registered against him under any of the provisions of the Maharashtra Prohibition act, liberty given to the applicant by this applicant shall be appropriately modified.
(iii) Applicant shall attend the trial Court regularly on all dates of hearing.
(iv) Applicant shall cooperate the trial Court in expeditious disposal of the trial.
Application is disposed of.
