The appellant - Pratibha Narayan Band has preferred this Appeal against an order dated 11.10.2019 passed by the Sessions Court, Akola, rejecting her application for Anticipatory Bail in Crime No. 352 of 2019 for the offence punishable under Sections 294 and 506 of the Indian Penal Code read with Section 3(1)(r)(s) of the Scheduled Tribes (Prevention of Atrocities) Act, 1989. It is stated that the husband of the appellant - co-accused, has already been granted regular bail by this Court. A perusal of the First Information Report and the charge sheet would reflect that against the present appellant, only general allegations of abuses
1401apeal127.20 on caste are made. No prima facie case for the alleged offence is made out.
Considering the role attributed to her, this Court is inclined to protect her and hence pass the following order.
Criminal Appeal is allowed. In the event of arrest, the appellant - Pratibha Narayan Band, be released on Anticipatory Bail on executing Personal bond of Rs.15,000/- (Rs. Fifteen thousand only) with one surety in the like amount.
