In view of pendency of Writ Petition No.6920 of 2013, the respondents have raised objection for filing of the writ petition. Because of that objection, learned counsel Shri R.S. Charpe seeks leave to withdraw the writ petition and to incorporate necessary amendment in pending petition.

Learned counsel Shri R.S. Khobragade and learned counsel Shri A.Y. Kapgate are opposing grant of liberty.

However, if any cause of action has arisen and it is open to the petitioner to assail it in Writ Petition No.6920 of 2016, it is always open to him to seek appropriate amendment therein. Such application .....2/-

if moved, needs to be decided as per law. Hence with said liberty and without prejudice to any of the defences available to the respondents in the matter, we dispose of Writ Petition No.1450 of 2015 as withdrawn. JUDGE JUDGE !! BRW !!
