Heard the learned counsel for the petitioners and the learned Assistant Government Pleader representing the Staterespondents. 2.

The prayer made in the writ petition is that the respondent no.2 be directed to decide the proposal for granting approval to the appointment of the petitioner no.3 on the post of Junior Clerk working with Gangaram Arts and Commerce Junior College, Masal, District Bhandara after quashing the letter dated 15.01.2024, whereby it has been informed to the Principal of the Institution that the proposal cannot be considered on account of Circular dated 01.08.2022 issued by the Government.

The learned Assistant Government Pleader on the basis of instructions has stated that now a Circular has been issued by the Director of Secondary and Higher Secondary, Pune on 01.03.2024 on the basis of which the approval as sought may be re-considered.

The Circular dated 01.03.2024 is taken on record and marked 'A' for identification.

Accordingly, in view of aforesaid, we dispose of the writ petition with direction to the respondent no.3 to re-consider the proposal for grant of approval to the appointment of the petitioner no.3 on the post of Junior Clerk in the Institution concerned afresh, with expedition within a period of four weeks from the date the certified copy of this order is produced before the said Authority. We further provide that the letter dated 15.01.2024 shall not come in way in view of the decision to be taken afresh by the respondent no.3 under this order. (NITIN W. SAMBRE, J.) (CHIEF JUSTICE) APTE
