The petitioner challenges the tender condition in the document bearing Bid No.GEM/2025/B/5792509 dated 28-01-2025 issued by respondent no.2 namely District Malaria Officer, Gadchiroli for supplying of Long Lasting Insecticidal Net for which he is required to deposit earnest money to the tune of Rs. 6 lakhs and granting no exemption from payment of the same to any of the participating prospective bidders who are registered under the Micro, Small and Medium Enterprises Development Act, 2006. Learned Senior Counsel for the respondent nos.1 and 2 submits that respondent no.2 has taken a decision to withdraw the aforesaid tender notice. The communication in this regard has been produced before us, which is taken on record. The petition is therefore dismissed as infructuous.
